1. Agreement to These Terms

These Terms & Conditions ("Terms") govern your access to and use of the Evara mobile application and the getevara.app website (together, the "Service"), operated by Fabulous Apps ("Evara", "we", "our", "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Adult Content

Evara contains explicit audio fiction intended for adults. You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to use the Service. By using Evara you represent and warrant that you meet this age requirement and that it is legal for you to access adult content where you live. If it is not legal for you to access such content, you must not use the Service.

3. Your Account

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, Billing and Cancellation

Evara offers auto-renewing subscriptions that unlock full access to the library. The following apply to purchases made through the Apple App Store:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• You can manage or cancel your subscription, and turn off auto-renew, in your Apple ID account settings after purchase.
• Prices are shown in the app before purchase and may vary by region and over time.
• Refunds are handled by Apple in accordance with the App Store terms; we do not process App Store payments directly.

Your use of subscriptions purchased through the App Store is also subject to Apple's Licensed Application End User License Agreement (EULA).

5. License to Use Evara

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial enjoyment. This license does not transfer any ownership rights to you.

6. Acceptable Use

You agree not to:

• Copy, download (except where the app expressly allows offline listening for your own use), record, redistribute, publicly perform, or resell any content from the Service;
• Share, sell, or transfer your account or subscription to others;
• Reverse engineer, decompile, or attempt to extract the source code or audio files of the app, except to the extent permitted by law;
• Circumvent, disable, or interfere with security or access-control features;
• Use the Service for any unlawful purpose or in violation of these Terms.

7. Intellectual Property and Content

All content in the Service, including audio recordings, stories, artwork, text, and the Evara name and logo, is owned by Evara or its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are granted to you. You may not use our trademarks without our prior written permission.

8. Content Disclaimer

Evara is a work of adult fiction created for entertainment. All characters depicted are fictional and are portrayed as consenting adults aged 18 or over. Any resemblance to real persons or events is coincidental. The content does not represent real advice and is intended solely for the personal enjoyment of adult listeners.

9. Termination

You may stop using the Service at any time and may delete your account from within the app or by contacting us. We may suspend or terminate your access if you breach these Terms or use the Service in a way that could cause harm or legal liability. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Evara and Fabulous Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising from your use of, or inability to use, the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws applicable at our place of business, without regard to conflict-of-law principles. Where you have mandatory consumer rights under the law of your country of residence, nothing in these Terms affects those rights.
